The rule

The freezer is one of the 14 items named in s. 38.1. Its warranty of good working order lasts 6 years, like the refrigerator and the stove. It starts on the day of delivery (s. 38.4).

Examples of covered breakdowns

  • The freezer no longer stays cold (compressor, thermostat).
  • The temperature alarm or the controls stop working.
  • The fan or the automatic defrost system breaks.

What isn't covered

  • Manual defrosting and cleaning, which are part of normal maintenance (s. 38.3).
  • Damage from abusive use.
  • Accessories not provided for by regulation, like a replacement basket.

Freezer in the garage: some models aren't designed for an unheated garage. Keep the manufacturer's guide. If the appliance was used outside the intended conditions, the merchant could dispute the claim. If the salesperson recommended it for that use, write it down.

After 6 years

The reasonable lifespan warranty (s. 38) can still protect you if the appliance gives out too early for its price.

It broke: the steps

  1. Gather your proof: the receipt and proof of the delivery date (email, delivery slip). Take a photo or video of the problem.
  2. Choose who to contact: the merchant, the manufacturer, or both. Neither one can send you to the other.
  3. Make your request in writing and keep a copy. Our free letter generator cites the right sections.
  4. If they refuse: see what to do when the store refuses.
