The rule
The heat pump is named in s. 38.1 and the regulation sets its warranty of good working order at 6 years. Parts and labour are included (s. 38.2), along with reasonable travel costs (s. 38.5).
Who to contact
The merchant, the manufacturer, or both. When a company sells and installs the heat pump, that company is the merchant. The manufacturer is the brand of the unit.
Examples of covered breakdowns
- The unit no longer heats or no longer cools (compressor, reversing valve).
- A persistent error code linked to a sensor or the control board.
- The fan in the outdoor or indoor unit stops turning.
What isn't covered
- Normal maintenance: cleaning or replacing filters, cleaning the coils (s. 38.3).
- Damage from abusive use.
- Accessories not provided for by regulation.
Delivery or installation? The law starts the warranty at delivery of the item (s. 38.4). For a heat pump delivered and installed the same day, it's simple. Otherwise, keep the receipt, the delivery slip and the installation date.
Maintenance matters
The manufacturer often recommends regular maintenance. Keep the maintenance invoices: they help show the breakdown isn't caused by a lack of maintenance.
It broke: the steps
- Gather your proof: the receipt and proof of the delivery date (email, delivery slip). Take a photo or video of the problem.
- Choose who to contact: the merchant, the manufacturer, or both. Neither one can send you to the other.
- Make your request in writing and keep a copy. Our free letter generator cites the right sections.
- If they refuse: see what to do when the store refuses.
Frequently asked questions
My installer charges me for the service call on a covered breakdown. Is that normal?
Reasonable transport costs related to a covered repair are paid by the merchant or the manufacturer (s. 38.5). Ask in writing what the charge is based on.
My heat pump is 3 years old and the manufacturer's warranty is over. Am I covered?
If it was bought new from a merchant since October 5, 2026, yes: the legal warranty lasts 6 years, regardless of the manufacturer's warranty.
Is a heat pump bought with a subsidy covered?
Yes. The subsidy changes nothing: the law covers the new item sold by a merchant to a consumer.
